The Ethics and Anti-Corruption Commission (EACC) has arraigned former and current Nakuru County officials over alleged conflict of interest and procurement irregularities involving county contracts worth Ksh120 million. The accused pleaded not guilty before the Nakuru Law Courts, where the court granted bail under varying terms and scheduled a pre-trial conference for September 12, 2026.

Officials from Nakuru county both former and current pleaded not guilty this morning before Chief Magistrate Tito Gesora. The Ethics and Anti-Corruption Commission (EACC) arrested them on Thursday over conflict of interest, ignoring procurement laws involving county contracts worth Ksh 120 million.  

The officials arrested include, Timothy Kiogora Murithi, Chief Officer for Water, Daniel Ndung'u Wainaina, Chief Officer for Medical, Peter Gitau Thabanja, Nakuru City Manager, Kenneth Muriithi Ndubi, director of the three companies, Kennedy Mungai Barasa, Chief Officer for Roads and Infrastructure, and Solomon Sirma, County Executive Committee Member for Finance in Baringo County and former Chief Officer for Health in Nakuru.

The Ethics and Anti-corruption Commission (EACC) directed that two officials Brian Mwenda Ndubi, director of Windcom Solutions Limited, and Josphat Kimemia, Chief Officer for Youth Affairs and Sports, who they believe went into hiding to report to South Rift Regional Office in Nakuru county or to the nearest EACC offices.

The defense lawyer Lawrence Karanja requested the court to be lenient to the suspects noting that they fully complied with the officers during the arrest.

“We pray that you release them on a reasonable bond term with an alternative of a cash bail.” He said.

Lorna Karamuta Mubichi, Kenneth Murriithi Ndubi, Brian Mwenda, were released on a Ksh 1M bond, and a surety of the same amount or cash bail of Ksh 500,000 and two contact persons. In addition, deposit their passports in court and shall be required to report to the EACC regional offices in Nakuru every fortnight beginning 14th August 2026 until ordered otherwise.

Daniel Wainaina Ndung’u, Kennedy Mungai Barasa, Timothy Kiogora Muriithi, Josephat Kimemia, Peter Gitau Thabanja, and Solomon Sirma, were released on a bond of Ksh 500, 000 and a surety of the same amount, or a cash bail of Ksh 200,000 and a contact person each. They are not required to report to the EACC offices.

For A10, A11, A12, which are companies that were charged separately from their directors, were released on free bond since their guarantors were present in court. The magistrate further directed that the witness statements documents to be used in the evidence, charge sheet, be supplied to the defense.

The matter is set for pre trial conference on 12th September 2026 in Nakuru law court number 1.
